This policy explains how Moss Atlas LLC, trading as Hazel & Orlaith ("we", "us"), collects and uses your personal information when you visit hazelandorlaith.com, shop with us or contact us.

1. Who is responsible for your information

  • Contact and order details: your name, email address, phone number, billing and delivery address, the products you order and your order history.
  • Payment information: payments are handled by our payment provider. We receive confirmation of your payment and limited details such as the card type and the last four digits, but never your full card number.
  • Communications: the emails and messages you send us, and our replies.
  • Device and usage information: your IP address, browser and device type, the pages you view, the products you add to your cart, and how you arrived at our website. We collect this through cookies, pixels and similar technologies.
  • Marketing information: whether you are subscribed to our emails, and whether you open or click them.

3. How we use your information

We use your information for the following purposes, on the legal basis shown:

  • To process, ship and deliver your order, send you order and tracking updates, and handle returns and refunds. Legal basis: performance of our contract with you.
  • To answer your questions and provide customer service. We use customer service software, including AI tools, to help us handle and reply to your emails. Legal basis: performance of our contract with you, and our legitimate interest in providing good customer service.
  • To prevent fraud, keep our website secure, and handle payment disputes and chargebacks. Legal basis: our legitimate interests in protecting our business and our customers.
  • To send you marketing emails, such as reminders about items left in your cart, offers and new arrivals. Every marketing email contains an unsubscribe link. Legal basis: your consent, or, where the law allows it for existing customers, our legitimate interest in telling you about similar products.
  • To measure and improve our website and advertising, and to show you relevant ads on other websites and apps. Legal basis: your consent, where the law requires it.
  • To keep tax and accounting records and comply with other legal obligations. Legal basis: compliance with our legal obligations.

4. Who we share your information with

  • Shopify, which hosts our online store and processes order information on our behalf.
  • Payment providers, which process your payment and carry out fraud checks.
  • Fulfilment partners and suppliers, which pack and ship your order, and delivery and tracking providers, which deliver it.
  • Advertising and analytics partners, such as Meta (Facebook and Instagram), Google, TikTok and Microsoft, and our conversion-tracking provider. They receive device and usage information through pixels on our website so that we can measure and personalise our ads.
  • Email and customer service providers, including our email provider and the software and AI providers that help us manage customer service.
  • Professional advisers, authorities and courts, where the law requires it or to protect our rights, and a buyer of our business if the business is sold.

We do not sell your personal information.

5. International transfers

We are based in the United States, and our service providers and fulfilment partners operate in several countries, including the United States and China. When your personal information is transferred outside the European Economic Area to a country that does not have an adequacy decision, we rely on safeguards recognised by law, such as the standard contractual clauses in our providers' data processing terms or the EU-US Data Privacy Framework where a provider is certified. Where no other safeguard applies, we transfer your information only where this is necessary to deliver your order.

6. Cookies and similar technologies

We use cookies and similar technologies that are necessary for our website and checkout to work, for example to remember what is in your cart. We also use analytics and advertising cookies and pixels from the partners listed in section 4.

You can block or delete cookies in your browser settings. Blocking some cookies may affect how our website works.

7. How long we keep your information

  • Orders and payments: for as long as tax and accounting laws require, usually 6 to 7 years.
  • Customer service emails: up to 3 years after our last contact with you.
  • Marketing: until you unsubscribe. We keep your email address on a suppression list so we do not email you again.
  • Analytics and advertising cookies: for the lifetime of each cookie, generally no longer than 13 months.

8. Your rights

Under the GDPR you have the right to access your personal information, to have it corrected or deleted, to restrict or object to how we use it, and to receive it in a portable format. You can object to direct marketing at any time, and where we rely on your consent you can withdraw it at any time.

9. Security

We use reasonable technical and organisational measures to protect your personal information, and our website uses an encrypted (HTTPS) connection. No method of sending or storing information is completely secure, so we cannot guarantee absolute security.

10. Children

Our website is not intended for children under 16, and we do not knowingly collect personal information from children.

11. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last updated.
